Abstract:

The three decades of turbulence in Kashmir accentuated to strife-ridden and conflict situation detrimental to the physical, mental and social health of people of Kashmir. The people gripped a substantial segment of the population to psychiatric and mental disorders. The State is facing the challenges of mental health patients in diagnosis, screening and cures within its poor infrastructure. The legal framework of mental health underpinned United Nations Convention for Rights of Persons with Disabilities (UNCRPD), 2008 intended to protect mental health disorders of people with disabilities. The Jammu & Kashmir Legal Services to Mental Disabilities Scheme, 2010 provides access to mental health patients in harmony with the UNCRPD, 2008. The Mental Healthcare Act, 1987 and 2017 along with judicial recognition institutionalizes health care and rehabilitation of mentally ill people. The paper is an empirical inquiry into the correlatives of turmoil in Kashmir and the incidence and prevalence of mental health issues of women and children from a socio-legal perspective.
