Abstract:
|
The purpose of this research is to find out and analyze the development of bank secrecy principle regulation in Indonesia, both related to the Indonesian government’s efforts to uncover various crimes and increase state revenues. The results showed that the regulation of bank secrecy principle that was initially more absolute gradually began to lead to a fairer and relative principle, given the many needs and interests of the community and the country, both from the domestic and international spheres, among others for the interest of increasing state revenues, disclosure of crimes, as well as the scope of transactions and interests of international relations. Considering that the basis of protection and guarantee of customer data is legislation (not contractual relationships), it is necessary to make a clear, standard, and integrated arrangement, both on the provisions of general principles, its understanding, its limitations, objectives, the authority of the relevant authorities, its exceptions, and the procedures of its application, so that its application is not interpreted differently, which in the end can harm the interests of bank customers and society in general.
