The Dynamics of Fatwa among a Diverse Community

Abstract: This paper aims to elaborate the dynamics of the struggle "legal fatwa" with social reality. This article tries to give a picture or portrait of the existence of a "fatwa" in the midst of society with various pros and cons. The main studies that will be discussed through this paper are, first, the urgency of "religious fatwa" in the midst of society. Second, the phenomenon of "Fatwa" with various pros and cons which gives birth to progressiveness and ‘regressivity’. Third, the potential for "fatwa" as a supporter of the NKRI and nationality frame. This paper does not pretend to assess the validity of "a fatwa" or any institution that issues a fatwa, therefore the approach used in this article is a social-historical approach, which attempts to examine the socio-political conditions surrounding the birth of a fatwa, and social implications or impacts in the form of public reaction to the "fatwa". Some points that become findings and answers of academic issues raised are, first, the existence of a fatwa is very urgent as an answer for Muslim communities who question the legal status of a problem in the midst of a process of socio-cultural transformation that continues to make the needs of Muslims of the 'legal status' of various issues. Second, the existence of fatwas in the community invites various social reactions. Fatwa 'can cause turmoil in the community if born from inadequate conditions. Fatwa that is born from the right process and thought will give birth to progressiveness in the form of productive social movements for the community, and vice versa, if the fatwa is born from various interventions it is not uncommon to cause regressive which actually makes it counterproductive to society. Third, the role of ulama as a symbol of religious authority in the arena of nationalism in Indonesia. Religious leaders have a very vital role to maintain the sovereignty of the Republic of Indonesia and strengthen the national spirit of the people, especially through their fatwas.
