Strategies and Legal Protection for Undocumented Indonesian Migrant Workers

Abstract:

This article examines legal protections for undocumented Indonesian migrant workers, and the Government of Indonesia’s strategies to address them. This is based on the fact that not all migrant workers can enter the territory of other countries in a legal manner according to the rule of law. Strict requirements, high entry fees to other countries and internal factors of migrant workers cause them to enter illegally, so that many undocumented migrant workers are found. As a result, they are very vulnerable to being exploited. This study uses a socio-legal approach that combines a legal approach and a social science approach. The data used in the form of primary data and secondary data obtained by means of observation, in-depth interviews and library research. The results of the study concluded that all migrant workers, both documented and undocumented have the right to legal protection.
